THE ENGLISH VERSION OF THESE TERMS IS THE AUTHORITATIVE TEXT. Where the English and Japanese versions differ, the English version prevails.
These Terms exist in English and Japanese only. If your AJPLINK interface is in Vietnamese, Indonesian, Nepali or Sinhala, the document you are agreeing to is this English one. Ask us before you register if anything here is unclear.

Article 1. Purpose and Scope
1. These Terms of Use govern use of the AJPLINK platform at ajplink.com ("the Service") by candidates residing outside Japan and by sending agencies located outside Japan.
2. Japanese host companies (受入機関), Japan Support Partners (登録支援機関・組合) and jobseekers already residing in Japan are governed instead by the Japan Terms of Use issued by Raicuru Co., Ltd. These Terms do not apply to them.
3. By registering for or using the Service as a candidate outside Japan or as a sending agency, you agree to these Terms. If you do not agree, do not use the Service.
Article 2. Contact Details

Article 3. Definitions
1. "Candidate" means an individual registered on the Service who is seeking employment in Japan and who resides outside Japan.
2. "Sending agency" means an organisation registered on the Service that sources, supports or represents candidates in their country of residence. On the Service this role is shown as 送出し機関.
3. "Host company" means a Japanese employer registered on the Service.
4. "Placement" means a candidate introduced through the Service being hired by a host company.
Article 4. What the Service Is, and What It Is Not
1. The Service is a platform that publishes job information and candidate information and lets the parties reach each other. It is not an employer, and it is not a party to any employment contract formed through it.
2. The Operator does not select, endorse, recommend or guarantee any candidate to any host company, and does not decide or take part in deciding whether a candidate is hired.
3. The Operator does not guarantee that any candidate will be hired, will be granted a status of residence, or will be permitted to enter Japan or to work there.
4. A sending agency is responsible for its own licensing under the law of its own country — see Article 15.
5. In Japan, the platform is operated as a job-information provision business by Raicuru Co., Ltd., which does not hold a Japanese employment-placement licence. See the Japan Terms of Use.
Article 5. Member Categories
AJPLINK has four member categories. These Terms bind the two that register outside Japan; the other two are named so that a reader of both documents sees one taxonomy rather than two.
Jobseeker members (求職者会員) — individuals who register their own information on the Service.
Company members (企業会員) — host companies (受入機関) in Japan that take on jobseekers.
Support members (支援会員) — Japan Support Partners (登録支援機関・組合) and overseas sending agencies (送出し機関).
Other members (その他会員) — language schools and any other party the Operator admits individually.
Of those, these Terms apply to candidate (jobseeker) members residing outside Japan and to sending agencies, which are support members. Company members and Other members are governed by the In-Japan Terms of Use.
A person may not register as both a jobseeker member and a sending agency member in respect of the same candidate.
Article 6. Registration and Eligibility
1. Only a person aged 18 or over may register as a candidate.
2. A sending agency must register through an individual authorised to bind it, and must be able to show that authority on request.
3. The Operator may verify identity, corporate existence and licensing before approving a registration, may refuse a registration, and is not obliged to give reasons.
4. A member is responsible for the security of its account and for everything done through it.
Article 7. Registered Information
1. A member must give information that is accurate, current and true, and must update it promptly when it changes.
2. No member may register false or misleading information, submit an altered or forged document, or register information about another person without that person's consent.
3. A sending agency that registers or edits information on a candidate's behalf does so as that candidate's agent, and is responsible to the candidate for its accuracy.
Article 8. Candidate Visibility
1. A candidate chooses one of the following visibility levels, which determines what host companies see of their registered information. A candidate may change the level at any time, and the change takes effect immediately.
Level A — searchable and viewable by company members.
Level B — the profile is shown, but the jobseeker's name, telephone number and e-mail address are withheld from company members.
Level C — full details are shown only to company members the jobseeker has approved.
Level D — not listed in the database, and outside the scope of search and scouting.
Level C requests: a company member with a confirmed interview with a Level C jobseeker may ask, through the Service, for that jobseeker's full details. The jobseeker decides. Until they approve, none of the information Level C withholds is disclosed. If they do not approve, the company member is told only that the details have not been shared, and no reason is given. The jobseeker may withdraw an approval at any time, with immediate effect.
2. A jobseeker's residence card number, passport number, My Number and bank account details are never shown to a company member or any other member, whatever visibility level applies.
3. A candidate's name is shown to a host company only where the candidate has chosen Level A AND an interview with that host company has been confirmed. Where Level B or Level C applies, the name is withheld from a host company that the candidate has not approved, even after an interview is confirmed.
4. A sending agency must not alter a candidate's visibility level without that candidate's instruction.
5. A candidate may close their account at any time. Closure is governed by the Outside-Japan Privacy Policy.
Article 9. Documents Withheld Until a Hire Is Confirmed
Identity documents, certificates and other files a candidate submits are NOT disclosed to a host company until a hire has been confirmed. Before then a host company sees only information within the visibility level the candidate has chosen. The choice of level does not change this: it is a separate rule and the stricter of the two always applies.
Article 10. The Service Is Free for Candidates
1. A candidate pays the Operator nothing for the Service, in any form, at any stage, ever. There is no registration fee, no subscription, no success fee and no deposit.
2. If anyone asks a candidate for money in connection with AJPLINK, the candidate should report it to the Operator at the contact address in Article 24.
Article 11. Sending Agency Fees
1. There is no charge for a sending agency to register or to use the Service.
2. Where a candidate introduced through the Service is hired by a host company, the sending agency shall pay the Operator ¥50,000 for that placement, exclusive of Japanese consumption tax (税別). Japanese consumption tax is added to that amount and is payable in addition to it.
3. The fee is payable once per placement and is not payable if no hire occurs.
4. The fees in these Terms supersede the fee models set out in any brochure, proposal or presentation issued before the effective date of these Terms. Where a sending agency holds a signed individual agreement stating different fees, the parties shall vary that agreement to match these Terms; until they do, the signed agreement governs between them.
Article 12. Withdrawal After Offer
1. Where a candidate withdraws after an offer has been made and while the application for a status of residence is in progress, the sending agency that introduced that candidate shall pay the Operator ¥100,000, exclusive of Japanese consumption tax (税別). This amount is not the same as the placement fee in Article 11.
2. THIS CHARGE FALLS ON THE AGENCY ALONE. It must not be recovered from the candidate, in whole or in part, directly or indirectly — see Article 13.
3. A candidate is free to withdraw at any time and owes nothing for doing so.
Article 13. No Charges to Candidates — Prohibition
1. A sending agency shall not collect, demand, accept or cause to be collected from a candidate any fee, commission, deposit, security, bond, penalty, liquidated-damages sum, training charge, document charge or other money, under any description, in connection with the Service or with a placement made through it.
2. A sending agency shall not pass on to a candidate any amount it owes to the Operator under Article 11 or Article 12, and shall not offset any such amount against a candidate's wages or any sum otherwise due to the candidate.
3. A sending agency shall not require a candidate to enter into any arrangement that binds the candidate by penalty, bond, deposit or forfeiture, nor retain a candidate's passport, residence card or other original identity document.
4. Japan's Specified Skilled Worker rules prohibit candidates being bound by penalty or deposit arrangements. This Article applies whether or not a particular arrangement is also prohibited by the law of the agency's own country.
5. The Operator may suspend or terminate a sending agency's account for a breach of this Article without prior notice, and may inform the affected candidate and the relevant host company that it has done so.
Article 14. Retention Support
1. A sending agency shall support the continued employment of each candidate it introduces, at that candidate's workplace, for 5 years from the candidate's arrival in Japan.
2. That support includes remaining contactable by the candidate, responding to difficulties the candidate raises about the workplace, and cooperating with the host company and the Japan Support Partner where a problem arises.
3. This obligation survives the payment of any fee under Article 11 and is not discharged by it.
Article 15. Sending Agency Obligations
A sending agency shall:
1. Hold every licence, registration and approval that the law of its own country requires for the recruitment and sending activity it carries out, and keep them current;
2. Recruit candidates honestly, and not misrepresent wages, working conditions, the cost of living in Japan, the length or nature of the visa, or the likelihood of a hire;
3. Use candidates' personal information obtained through the Service only for the purposes of recruitment, placement and post-arrival support;
4. Not sub-contract its obligations without the Operator's written agreement; and
5. Notify the Operator promptly if a licence is suspended, withdrawn or not renewed.
Article 16. Interviews and Hiring Decisions
1. The Operator provides a facility for relaying interview-scheduling messages between the parties. It does not conduct interviews and is not responsible for their content or outcome.
2. A hiring decision is made by the host company alone. The Operator has no part in it and is not responsible for a candidate not being hired.
Article 17. Personal Information
Personal information collected through the Service from candidates outside Japan and from sending agencies is handled in accordance with the Outside-Japan Privacy Policy, which forms part of these Terms.
Article 18. Prohibited Conduct
No member may:
1. Misrepresent identity, qualifications or authority;
2. Submit a false, altered or forged document;
3. Use the Service for anything other than legitimate recruitment and employment;
4. Extract, copy, store, resell, redistribute or republish candidate information obtained through the Service, or publish it outside the Service, beyond what recruitment and employment management require;
5. Contact a candidate for a purpose unconnected with employment introduced through the Service; or
6. Breach the law of Japan, of the candidate's country of residence, or of its own country.
Article 19. Suspension and Termination
1. The Operator may suspend or terminate a member's account where the member breaches these Terms, provides false information, or places a candidate at risk.
2. A member may close its account at any time. Termination does not affect Article 13, Article 14 or any amount already due.
Article 20. Disclaimer and Limitation of Liability
1. The Operator does not warrant the accuracy, completeness or lawfulness of information registered by members.
2. The Operator is not responsible for the outcome of a placement, a visa application, an employment arrangement, or the conduct of any member.
3. Nothing in these Terms excludes liability for the Operator's own fraud, wilful misconduct or gross negligence, or any liability that applicable law does not permit to be excluded.
Article 21. Changes to These Terms
1. The Operator may amend these Terms. An amended version takes effect when it is posted on the Service.
2. Advance notice of a material change will be given on the Service or to the member's registered email address.
3. The Operator records the version of these Terms that each member accepted at registration, and a member may ask to be told which version that was.
Article 22. Language
1. These Terms are provided in English and in Japanese. WHERE THE TWO VERSIONS DIFFER, THE ENGLISH VERSION PREVAILS.
2. The AJPLINK interface may be displayed in English, Japanese, Vietnamese, Indonesian, Nepali and Sinhala. THESE TERMS EXIST IN ENGLISH AND JAPANESE ONLY. A candidate whose interface language is Vietnamese, Indonesian, Nepali or Sinhala is agreeing to the ENGLISH text, and a machine translation of it forms no part of these Terms.
3. A member who does not understand the English text should seek an explanation before registering. The Operator will answer questions about these Terms at the contact address in Article 24.
Article 23. Governing Law and Jurisdiction
1. These Terms are governed by the laws of Sri Lanka.
2. Any dispute arising from or relating to these Terms or the Service is subject to the exclusive jurisdiction of the competent courts of Colombo, Sri Lanka.
3. This Article does not deprive a candidate of the protection of any mandatory law of their own country of residence.
